Acceptance of these terms
By using this website, submitting an enquiry, or engaging Davesh PS Chauhan & Co. for professional services, you accept these terms. Where a separate signed engagement letter exists, that letter governs the specific engagement and these terms apply to everything not covered by it.
Scope of our services
Our services are limited to what is set out in writing in the engagement letter or quotation for each assignment — typically income tax, property tax, GST, audit, accounting, company formation and ROC compliance work.
Work outside that agreed scope, including new registrations, representation in fresh proceedings, or restatement of earlier years, is treated as a separate assignment and quoted separately before it begins.
Fees and payment
Fees are quoted in writing and fixed for the agreed scope before work begins. Government fees, statutory levies, stamp duty, portal charges and out-of-pocket expenses are payable in addition and are charged at actuals.
Invoices are payable within fifteen days. We may suspend work on an assignment where fees remain unpaid beyond that period, after informing you. Fees already invoiced for work performed are not refundable, and fees for services withdrawn before completion are charged in proportion to the work done.
Your responsibilities
Timely and accurate information is what makes compliance possible. You agree to provide complete records, documents and explanations when requested, to review and approve returns and statements before we submit them, and to inform us promptly of notices, demands or changes in your business.
We rely on the information you provide. We are not responsible for consequences arising from information that is incomplete, inaccurate or provided too late to act on.
Deadlines and statutory dates
We maintain a compliance calendar for each client and inform you of upcoming due dates. Meeting a statutory deadline depends on receiving your records and approvals with reasonable time in hand — we specify that time in writing for each filing.
Interest, late fees or penalties arising from delayed information, delayed approval, or non-payment of statutory dues by you remain your liability.
Nature of advice given
Our advice is based on the law, notifications and judicial precedent as they stand on the date it is given, and on the facts disclosed to us. Tax and regulatory positions change, and authorities may take a different view.
We do not guarantee any particular outcome in an assessment, appeal, refund or registration. Nothing on this website constitutes professional advice for your specific situation; it is general information and should not be acted on without consulting us.
Limitation of liability
Our liability for any claim arising out of an engagement is limited to the professional fees received for that engagement, except where liability cannot be limited by law or under the regulations of the ICAI.
We are not liable for indirect or consequential losses, including loss of profit, business or reputation, and we accept no liability to third parties who rely on our reports or filings without our written consent.
Confidentiality
We keep your information confidential in accordance with our Privacy Policy and our obligations under the Chartered Accountants Act, 1949 and the ethical standards of the ICAI. You likewise agree to keep our reports, working papers and advice confidential and not to circulate them to third parties without our consent.
Ending an engagement
Either of us may end an engagement with reasonable written notice. On termination, we will invoice for work performed to that date and hand over your records and the documents you are entitled to receive.
We may decline or withdraw from an engagement where continuing would breach professional independence requirements or where information has been withheld or misrepresented.
Website use and intellectual property
The content, layout, text and design of this website belong to Davesh PS Chauhan & Co. You may read, print and share pages for your own reference, but you may not copy, republish or use the content commercially without written permission.
